    Your interactions and transactions with third parties are between you and the applicable third party and may be governed by separate terms and privacy policies.

    You assume responsibility for evaluating third-party products, services, websites, and information before relying on or purchasing from them.

    You are responsible for content you submit.

    You agree not to submit content that is unlawful, defamatory, threatening, abusive, harassing, fraudulent, misleading, obscene, infringing, invasive of another person's privacy, or otherwise inappropriate.

    You represent that you own or have the necessary rights to submit the content.

    By submitting content intended for public display on the Site, you grant Tasting with Tina a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and distribute that content as reasonably necessary to operate and promote the Site.

    We are not obligated to monitor user-submitted content, but we reserve the right to review, moderate, edit, refuse, or remove content at our discretion.

    9. Idea Submissions

    Please do not submit confidential business ideas, proprietary recipes, inventions, concepts, creative works, or other information that you expect us to keep confidential unless we have entered into a written confidentiality agreement with you.

    If you voluntarily submit ideas, suggestions, feedback, or similar material without such an agreement, you acknowledge that the submission is not confidential and that we may use the feedback or suggestion without restriction or compensation to you, subject to applicable law.

    10. Recipes, Food Safety, and Nutrition Information

    Recipes and cooking information provided on Tasting with Tina are for general informational and educational purposes.

    Cooking conditions, appliances, ingredients, preparation methods, ingredient brands, elevations, and other factors vary. You are responsible for using appropriate food-safety practices and determining whether food has been safely prepared.

    Where internal temperatures are provided, they are intended as general guidance and should be considered together with current food-safety recommendations from appropriate authorities.

    Nutrition information, when provided, is an estimate and may vary substantially depending on the ingredients, brands, quantities, substitutions, serving sizes, and calculation methods used.

    We do not guarantee the accuracy or completeness of nutritional estimates.

    You are responsible for determining whether a recipe, ingredient, product, or substitution is appropriate for you or anyone you serve, including with respect to allergies, intolerances, dietary restrictions, medical conditions, pregnancy, or other individual circumstances.

    Nothing on the Site constitutes medical or nutritional advice from a healthcare professional.

    11. Termination or Modification of the Site

    We may modify, suspend, restrict, or discontinue all or part of the Site at any time without notice.

    We may also restrict or terminate your access to the Site if we reasonably believe you have violated these Terms or applicable law.

    To the maximum extent permitted by law, we will not be liable for any modification, suspension, interruption, or discontinuation of the Site or any feature or content.

    12. Disclaimer of Warranties

    THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTING WITH TINA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.

    • THIRD-PARTY PRODUCTS OR SERVICES WILL MEET YOUR EXPECTATIONS; OR
    • THE SITE OR ITS SERVERS WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

    Nothing on this Site constitutes legal, financial, medical, or other individualized professional advice.

    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTING WITH TINA, AND OUR VENDORS AND SERVICE PROVIDERS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SITE.

    THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE CLAIM IS BASED ON CONTRACT, WARRANTY, STATUTE, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF TASTING WITH TINA AND OUR VENDORS OR SERVICE PROVIDERS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

    (A) THE AMOUNT YOU PAID DIRECTLY TO TASTING WITH TINA THROUGH THE SITE DURING THE SIX MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

    (B) ONE HUNDRED U.S. DOLLARS ($100).

    Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

    14. Privacy and Consent to Data Collection

    Our Privacy Policy is incorporated into these Terms by reference and explains how we, our vendors, and our service providers collect, use, disclose, and otherwise process information when you use the Site.

    By using the Site, you acknowledge and, where applicable, consent to the collection and use of information as described in our Privacy Policy, including the policies and disclosures linked within it.

    Our Privacy Policy is available at:

    Privacy Policy

    Where applicable, you may opt out of certain uses of personal information for cross-context behavioral advertising, targeted advertising, sale, or sharing by following the instructions provided in our Privacy Policy or by using privacy-choice links made available on the Site.

    Nothing in this section limits privacy rights that cannot legally be waived or restricted.

    15. Accessibility

    We are committed to making the content we provide reasonably accessible to individuals with disabilities.

    If you experience difficulty accessing any portion of the Site because of a disability, please contact us and describe the accessibility issue you encountered.

    We will make reasonable efforts to identify and address accessibility issues that are readily identifiable and reasonably remediable using available technology and practices.

    16. Affiliate Marketing, Advertising, and Sponsored Content

    Tasting with Tina participates in affiliate-marketing programs. We may receive a commission when you purchase products or services through certain links on the Site, at no additional cost to you.

    We may also receive compensation for sponsored content, advertising, brand partnerships, product placements, or other commercial relationships.

    We aim to disclose material relationships in accordance with applicable Federal Trade Commission requirements.

    The presence of an affiliate link or sponsored relationship does not change your responsibility to evaluate whether a product or service is appropriate for you.

    Specific affiliate programs may be subject to additional disclosures contained in our Disclaimer.

    17. Assignment

    You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

    We may assign or transfer our rights and obligations under these Terms in connection with a sale, reorganization, merger, acquisition, transfer of assets, or similar business transaction, subject to applicable law.

    18. Breaches of These Terms

    If you violate these Terms, we may take reasonable action to protect the Site and our rights, including restricting or terminating access, removing content, preserving evidence, contacting appropriate service providers, or pursuing available legal remedies.

    19. Force Majeure

    We will not be responsible for delays, interruptions, or failures caused by events beyond our reasonable control, including natural disasters, severe weather, power or telecommunications outages, cyberattacks, acts of government, labor disputes, public-health emergencies, failures of third-party infrastructure, or similar events.

    20. Indemnification

    To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Tasting with Tina and its owner, affiliates, service providers, contractors, and agents from claims, liabilities, losses, damages, expenses, and reasonable attorneys' fees arising out of or relating to:

    • your violation of these Terms;
    • your unlawful use of the Site;
    • content you submit through the Site; or
    • your infringement of another person's rights.

    This provision does not require you to indemnify any party for conduct for which indemnification cannot lawfully be required.

    21. Binding Arbitration ("Arbitration Agreement")

    PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY AND YOUR ABILITY TO PARTICIPATE IN CERTAIN CLASS OR REPRESENTATIVE ACTIONS.

    21.1 Applicability of Arbitration Agreement

    You agree that, except as specifically provided below, any dispute or claim against Tasting with Tina or our vendors or service providers (collectively for purposes of this Arbitration Agreement, "we," "us," or "our") relating in any way to:

    • your access to or use of the Site;
    • these Terms;
    • the Privacy Policy;
    • information collected, transmitted, or processed in connection with the Site; or
    • any aspect of your relationship with us

    will be resolved through binding arbitration rather than in court.

    However:

    1. you may bring an individual claim in small claims court if the claim qualifies and remains in that court on an individual, non-class, and non-representative basis; and
    2. either party may seek equitable or injunctive relief in court for infringement or misuse of intellectual-property rights, including copyrights, trademarks, trade dress, trade secrets, patents, or domain names.

    The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.

    To the maximum extent permitted by applicable law, you must commence any arbitration or other claim within one year after the dispute or claim arises, or the claim will be permanently barred.

    This Arbitration Agreement applies, to the maximum extent permitted by law, to claims that arose or were asserted before the effective date of these Terms or a prior version of this Arbitration Agreement.

    Nothing in this section limits any right or remedy that applicable law prohibits us from limiting or waiving.

    21.2 Informal Dispute Resolution Required Before Arbitration

    Before commencing arbitration, the party asserting a claim must provide written notice describing the dispute in reasonable detail.

    A notice sent to Tasting with Tina must include:

    • the claimant's full name;
    • mailing address and email address;
    • a description of the legal claim;
    • the specific facts giving rise to the dispute;
    • relevant dates and transactions or interactions, if applicable; and
    • the specific relief requested.

    Notices to Tasting with Tina must be sent by email to [email protected] with the subject line "Notice of Dispute."

    The parties agree to attempt in good faith to resolve the dispute informally. If the dispute has not been resolved within 30 days after receipt of a complete written notice, either party may initiate arbitration as provided below.

    21.3 Arbitration Procedures

    Arbitration will be administered by JAMS.

    Claims and counterclaims involving less than $250,000, excluding attorneys' fees and interest, will be administered under the then-current JAMS Streamlined Arbitration Rules and Procedures.

    Other claims will be administered under the then-current JAMS Comprehensive Arbitration Rules and Procedures.

    Information regarding JAMS and its rules is available at https://www.jamsadr.com/.

    If JAMS is unavailable or unwilling to administer the arbitration, the parties will attempt in good faith to select another recognized arbitration provider.

    The arbitration may be conducted remotely, through written submissions, or in person at a mutually agreed location, as permitted by the applicable rules and law.

    A court of competent jurisdiction may enter judgment on the arbitrator's award.

    21.4 Arbitration Fees

    Arbitration fees will be allocated in accordance with the applicable JAMS rules and applicable law.

    If an arbitrator determines that you cannot afford required filing, administrative, or hearing fees and you cannot obtain a waiver through JAMS, we will pay those fees to the extent required by applicable law.

    If the arbitrator determines that a claim was frivolous or brought for an improper purpose, the arbitrator may allocate fees, costs, or attorneys' fees to the extent permitted by applicable law and the applicable arbitration rules.

    21.5 Authority of the Arbitrator

    Except where applicable law requires otherwise, the arbitrator will have authority to resolve disputes concerning the interpretation, applicability, enforceability, or formation of this Arbitration Agreement.

    The arbitrator may award any individualized monetary or non-monetary relief that would be available in a court of competent jurisdiction under applicable law.

    The arbitrator will issue a written decision explaining the essential findings and conclusions supporting the award.

    The arbitrator's award will be final and binding, subject only to the limited review permitted under applicable arbitration law.

    21.6 Waiver of Jury Trial

    TO THE EXTENT PERMITTED BY LAW, YOU AND TASTING WITH TINA WAIVE ANY CONSTITUTIONAL OR STATUTORY RIGHT TO HAVE A DISPUTE COVERED BY THIS ARBITRATION AGREEMENT DECIDED BY A JUDGE OR JURY IN COURT.

    Instead, covered claims will be resolved through arbitration except as expressly provided in this Arbitration Agreement.

    21.7 Waiver of Class or Consolidated Actions

    Except for the Batch Arbitration process described below, claims covered by this Arbitration Agreement must be brought on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, mass, or representative action.

    The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim.

    If this class-action waiver is determined to be invalid or unenforceable with respect to a particular claim or request for relief, that claim or request for relief will proceed in court rather than arbitration to the extent required by applicable law.

    21.8 Batch Arbitration

    If 50 or more substantially similar individual arbitration demands are filed against us within approximately a 30-day period or otherwise in close proximity and are coordinated by the same or affiliated counsel or organizations, the demands may be administered through a batch process.

    Claims are considered substantially similar when they arise from the same or substantially similar event, agreement, conduct, or factual circumstances and raise the same or substantially similar legal issues.

    The parties will cooperate in good faith with JAMS regarding efficient administration of such demands.

    JAMS may administer substantially similar demands collectively before a single arbitrator or, where a single proceeding would be impracticable or inequitable, in groups of not fewer than 20 claims plus any necessary remainder group, to the extent permitted by applicable law and JAMS procedures.

    The batch process does not authorize class arbitration or permit any claimant to pursue claims on behalf of another person.

    Any dispute regarding whether the Batch Arbitration provision applies will be resolved by the arbitrator in accordance with applicable law.

    21.9 Severability

    If any portion of this Arbitration Agreement is determined to be invalid or unenforceable, that provision will be severed or modified to the minimum extent necessary, and the remainder of the Arbitration Agreement will remain in effect, except where these Terms expressly provide otherwise.

    21.10 Survival

    This Arbitration Agreement survives termination of your access to or relationship with the Site.

    21.11 Changes to Arbitration Agreement

    If we make a material change to this Arbitration Agreement in the future, that change will not apply to an individual dispute for which you provided us complete written notice before the effective date of the change.

    22. Waiver

    Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

    Any waiver must be in writing to be effective unless applicable law provides otherwise.

    23. Severability

    Except as specifically provided in the Arbitration Agreement, if any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible or severed, and the remaining provisions will remain in full force and effect.

    24. Entire Agreement

    These Terms, together with our Privacy Policy, Disclaimer, and any additional terms expressly applicable to a particular product or service, constitute the agreement between you and Tasting with Tina regarding your use of the Site.

    25. Updating These Terms and Conditions

    We may update these Terms periodically to reflect changes in our practices, technology, services, legal requirements, or other circumstances.

    When we update these Terms, we will revise the "Last updated" date at the top of this page.

    Unless otherwise stated or required by law, updated Terms become effective when posted on the Site.

    Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

    Material changes to the Arbitration Agreement are also subject to Section 21.11 above.

    26. Choice of Law and Jurisdiction

    Except to the extent governed by the Federal Arbitration Act or otherwise required by applicable law, these Terms will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

    For any dispute that is not subject to arbitration under these Terms, you and Tasting with Tina consent to the exclusive jurisdiction of the state and federal courts having jurisdiction in Missouri, unless applicable law provides otherwise.

    Nothing in these Terms deprives a consumer of rights or protections that cannot lawfully be waived under the law applicable to that consumer.
